Welcome to the Waves of Hope Grief Counselling website (Website). Waves of Hope Grief Counselling provides counselling (in person and online), workshops and webinars (Services).
Waves of Hope Grief Counselling has the right to review and change these Terms at its sole discretion at any time without notice. Waves of Hope Grief Counselling shall not be held liable to you or any third party for any modification, suspension or discontinuance of the Website or Service. Before you continue, we recommend you keep a copy of these Terms for your records.
2. Your Obligations as a Member
You have the sole responsibility for the confidentiality of your password and/or email address. Any use of your registration information by another person or third party is strictly prohibited. Please notify Waves of Hope Grief Counselling of any unauthorised use of your email, password or other security breach you have become aware of.
Be aware of clicking links to external websites. You do so at your own risk and Waves of Hope Grief Counselling will not be held liable for costs, loss or damage associated with doing so. By clicking on a link to an external website, you warrant that you have read, understood and agree to be bound by the Terms and Conditions which are available on that website.
You agree that you will not use this service or website for commercial endeavours without the approval of Waves of Hope Grief Counselling. You agree that commercial advertisements, affiliate links or solicitation will be removed from this website without notice and legal action may be taken for illegal or unauthorised use of the website.
3. Acceptance of the Terms
By using, browsing or reading any part of the website, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
4. Payment
All payments made using this service are made using bank transfer unless otherwise stated. When making payment in relation to the use of the services you warrant that you have read, understood and agree to be bound by the Terms and Conditions which are available on that website. You acknowledge and agree that when a payment is returned or denied for whatever reason by your financial institution, or unpaid by you for any other reason, then you are liable for any costs including banking fees and charges.
5. Fees, Cancellation, Refunds & No Show Policy
24 hours’ notice of cancellation or rescheduling is required so that we can offer your appointment time to someone else. If you give us 24 hours or more notice of cancellation, we will refund you the full amount or you can reschedule and payment received will be allocated to the new session time. If 24 hours’ notice of cancellation or rescheduling is not provided to us, you are a no show to your appointment, or you do not attend your rescheduled appointment time, refunds will be not provided. If you cannot attend your appointment due to illness or injury, a medical certificate must be provided for a refund to be considered on a case-by-case basis.
Please note that fees are subject to change without notice.
6. Copyright and Intellectual Property
The Website, the Services and all related products of Waves of Hope Grief Counselling are subject to Copyright. The material on this website is governed by the laws of Australia and through international treaties.
You acknowledge and agree that all content and materials on the Waves of Hope Grief Counselling website are protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. Except as expressly authorised by Waves of Hope Grief Counselling, you agree not to sell, licence, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from such materials and content.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. You agree to indemnify Waves of Hope Grief Counselling for any costs, loss or damage (including legal fees) incurred, suffered or arising out of or in connection with the content of this site or service. Or any consequences (direct or indirect) of you accessing, using and transacting on the website or attempts to do so. Or breaching the terms.
10. Jurisdiction & Dispute Resolution
Waves of Hope Grief Counselling is located in Victoria, Australia. This agreement and terms are subject to the governing laws of Victoria, Australia. If a dispute arises out of or relates to the terms, either party may not commence any tribunal or court proceedings in relate to the dispute unless the following clauses have been complied with (except where urgent interlocutory relief is sought):
a. Notice
A party to the terms claiming a dispute (Dispute) has arisen under the terms, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the dispute. Upon receipt of the notice within fourteen (14) days, you and Waves of Hope Grief Counselling agree to make a genuine effort in good faith to resolve the dispute through negotiation and discussion.
b. If for any reason whatsoever, after 14 days, if the dispute has not resolved, the parties must proceed to mediation with the assistance of an accredited mediator who is independent of the parties. The mediator is to be appointed by agreement of the parties or, failing agreement within twenty-one (21) days of the first notification of the dispute, by a person appointed by the Chair of Resolution Institute, Chatswood NSW, Ph: +61 2 9251 3366, Email: infoaus@resolution.insitute or the Chair’s designated representative. The Resolution Institute Mediation Rules shall apply to the mediation. The mediation shall occur in Melbourne, Victoria.
c. The parties are equally liable for the fees and reasonable expenses of a mediator and the costs of a venue for mediation. The parties must each pay their own costs associated with the mediation. Each party must pay any amounts requested by the mediator as a precondition to the mediation commencing. Litigation is to be considered a last resort and may not be commenced until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.
